§ 65035 State Land Use Coordination

Key Takeaways

  • •There is one main state office in charge of planning how land is used in the state.
  • •This office helps different state agencies work together on planning.
  • •The office also helps and checks on local and regional planning.
  • •The office does not have the power to directly control land use or projects.

Example

A city wants to build a new park but isn't sure how it fits with the state's plans.

The Office of Land Use and Climate Innovation would help the city understand the state's land use policies and make sure the park plan fits well with other plans in the area. However, the office can't directly approve or stop the park project.

§ 65035 State Land Use Coordination

The Legislature finds that it is necessary to have one agency at the state level that is responsible for developing state land use policies, coordinating planning of all state agencies, and assisting and monitoring local and regional planning. The Legislature recognizes the Office of Land Use and Climate Innovation, in the office of the Governor, as the most appropriate state agency to carry out this statewide land use planning function. It is not the intent of the Legislature to vest in the office any direct operating or regulatory powers over land use, public works, or other state, regional, or local projects or programs. (Amended by Stats. 2024, Ch. 41, Sec. 44. (SB 164) Effective June 29, 2024.)
