§ 61123 District Service Fee Limits

Key Takeaways

  • •The district can charge fees for services or enforcing rules, but the fee can't be more than what it actually costs them.
  • •Before raising fees for property services, they must follow special rules in the California Constitution.
  • •They can charge residents less than non-residents for the same service.
  • •They can sometimes let people skip paying the fee if it’s not fair or good for the public, but they must have clear rules for this.

Example

If the district cleans up a park and charges people to use it, they can’t charge $100 if it only costs them $20 to clean it.

The fee must match the real cost. If they try to charge too much, it’s not allowed.

No fee shall exceed the costs reasonably borne by the district in providing the service or enforcing the regulation for which the fee is charged. (b) Before imposing or increasing any fee for property-related services, a board of directors shall follow the procedures in Section 6 of Article XIII D of the California Constitution. (c) A board of directors may charge residents or taxpayers of the district a fee authorized by this section that is less than the fee which it charges nonresidents or nontaxpayers. (d) A board of directors may authorize district employees to waive the payment, in whole or in part, of a fee authorized by this section when the board of directors determines that payment would not be in the public interest. Before authorizing any waiver, a board of directors shall adopt a resolution that specifies the policies and procedures governing waivers. (Repealed and added by Stats. 2005, Ch. 249, Sec. 3.
