§ 57459 Revenue Enterprise Debt Protection

Key Takeaways

  • •If a district is dissolved, the new owner must pay all the old debts first before doing anything else with the money-making stuff (like selling it or giving it away).
  • •The new owner can't sell or mortgage the money-making stuff unless the original rules for the debts say it's okay.
  • •The new owner can't split up the money-making stuff when giving it to a city or county—they have to give all of it.

Example

A small town shuts down its water district, which still owes money for old loans. The town takes over the water system.

The town can't sell the water towers or pipes to pay for new roads until all the old water district loans are paid off. They also can't give just half the water system to the county—they have to give the whole thing.
