§ 5061 Public Obligation Registration Rules

Key Takeaways

  • •This law usually applies to registered public obligations (like bonds) unless the issuer decides otherwise before or when they are first issued.
  • •Even if other laws say something different, this law wins if it applies.
  • •This law doesn’t stop anyone from issuing obligations in other ways allowed by law.
  • •If obligations were already approved before, they don’t need to be approved again just to follow this law.

Example

A city wants to issue bonds to build a new park.

The city can use this law to issue the bonds unless they decide otherwise. Even if an old law says something different, this law applies. The city doesn’t need to ask voters again if they already approved the bonds before.
