§ 50020 Local Legislative Action Compliance

Key Takeaways

  • •If a law says a local group must make a decision by a 'resolution' (a simple vote or agreement)
  • •But the local group's own rules say they must make decisions by an 'ordinance' (a more formal, written rule)
  • •Then making the decision by 'ordinance' is okay and follows the law just fine

Example

A city council needs to decide on a new park rule. The state law says they must use a 'resolution,' but the city's own rules say they must use an 'ordinance.'

The city council can follow their own rule and use an 'ordinance' instead of a 'resolution.' This still counts as following the state law.
