§ 30102 State Controller Settlement Deferral

Key Takeaways

  • •If a county doesn't collect enough money (like taxes), the State Controller can wait to settle the money until later.
  • •The county must include all the money they should have reported in their next report to the State.
  • •No extra money (like travel pay or fees) will be given to any officer for the delayed settlement.

Example

A county didn't collect enough taxes this year, so they don't have enough money to pay the state what they owe.

The State Controller can say, 'Wait until next time to pay.' The county must then add all the missing money in their next report. Also, no extra pay (like mileage or fees) will be given to any officer because of this delay.

If it appears to the State Controller from the report of the county auditor that sufficient taxes or other revenues have not been collected to make it for the interest of the State that a settlement be made, the State Controller shall defer the settlement until the next regular settlement, and the county auditor shall include in his next report to the State Controller all money required to be reported since the date of his last report upon which a settlement was made. No mileage, fees, or commissions shall be allowed to any officer for any deferred settlement. (Added by Stats. 1947, Ch. 424.)
