§ 26509 District Attorney Consumer Fraud Access

Key Takeaways

  • •If someone is being checked for cheating customers, the district attorney can see complaints and investigations about them.
  • •If the district attorney doesn't do anything about the complaint, the information stays secret.
  • •If sharing the info could mess up an investigation, the agency can wait to share it.
  • •This rule is for agencies that check if people are allowed to do their jobs, like doctors, builders, or hairdressers.

Example

A doctor is accused of charging people for treatments they didn't get. The district attorney is checking if the doctor is cheating people.

The district attorney can look at all the complaints and investigations about the doctor, even if they're usually secret. But if the doctor isn't doing anything wrong, the complaints stay secret.
