§ 25906 County Fair Nonprofit Contracts

Key Takeaways

  • •The county can make a deal with a nonprofit group to run an agricultural fair in the county.
  • •The deal can let the nonprofit group use and manage public parks or fairgrounds during the fair.
  • •The county can give money to the nonprofit group to help with the fair, but if state money or property is involved, the state has to approve the deal.
  • •If the county wants state money for the fair, the nonprofit group must send a yearly budget to the state, and the county must approve it first.

Example

A county wants to have a big fair to show off local farms and animals.

The county can ask a nonprofit group to run the fair. They can let the group use the county fairgrounds and give them some money to help pay for things like rides and food stands. But if the county used state money to buy the fairgrounds or wants state money for the fair, they have to get the state's okay first. Also, the nonprofit group has to send a budget to the state every year to keep getting that money.

§ 25906 County Fair Nonprofit Contracts

The board of supervisors of a county may contract with a nonprofit corporation or association for the conducting of an agricultural fair in the county for the period and under those conditions as the board may determine. The contracts may provide for the use, possession, and management of any public park or fairgrounds by the nonprofit corporation during the period of the contract. When that use, possession, and management is granted, the board may also allocate to the nonprofit corporation a sum of money it deems necessary to be used for any purpose incidental to the fair. If the contract involves the use of property acquired with money derived from the state or if the contract contemplates the use of money allocated or appropriated by the state for the fair, the contract shall be subject to approval by the Department of Food and Agriculture. If the county desires to receive an allocation under Section 3200 of the Food and Agricultural Code, the corporation shall submit an annual budget to the Department of Food and Agriculture, showing the estimated revenues and the proposed expenditures from all sources during the ensuing calendar year, which budget shall first be approved by the board of supervisors. The corporation shall also comply with any other law relating to county fairs as a condition necessary for the county to receive an allocation of state money for fair purposes. Upon the dissolution of any such corporation, all property and assets thereof within the county with which it contracts shall be paid to that county. (Amended by Stats. 2024, Ch. 559, Sec. 76. (AB 2143) Effective January 1, 2025.)
