§ 25660 Public Fishing Highways

Key Takeaways

  • •The county can turn parts of rivers or streams into public fishing spots if they meet certain rules.
  • •The river or stream can't be on farmland or used for big boats.
  • •The river or stream must have fish put in it by the state or county.
  • •Once the county says it's a public fishing spot, people can fish there, but there might be some limits.

Example

A small river near a town has lots of fish because the state puts fish in it every year. It's not on any farmland, and no big boats use it.

The county can decide to make this river a public place for fishing. After they make this rule, anyone can go there to fish, but they still have to follow any other fishing rules.

§ 25660 Public Fishing Highways

On the application of any person interested, the board of supervisors may by ordinance declare all or any portion of any slough, river, or stream to be a public highway for the purpose of fishing therein, if it: (a) Does not lie within or run through cultivated land lying within the county. (b) Is stocked or supplied in whole or in part with fish by the state or counties. (c) Has not been declared by law to be navigable and in fact is not navigable for commercial purposes. From the time the ordinance becomes effective, the slough, river, or stream is a public highway for such purpose, subject only to the reservations contained in this article.
