§ 25376 County Historical Property Transfer

Key Takeaways

  • •The county can give old, extra buildings or land to a local history group if it's important to the county's past.
  • •The history group must be a nonprofit and promise to fix up and take care of the place.
  • •If the history group sells the place to someone who isn't a nonprofit history group, the county gets it back.

Example

Imagine an old schoolhouse that the county doesn't use anymore. It's really old and shows what schools were like 100 years ago.

The county can give this schoolhouse to a local history group for free or cheap, but the group has to promise to fix it up and keep it as a historical place. If the group later sells it to a business that wants to turn it into a store, the county takes the schoolhouse back.

§ 25376 County Historical Property Transfer

Notwithstanding anything in this chapter to the contrary, the board of supervisors may convey, upon such terms and conditions as the board determines to be in the public interest, any surplus real property, together with any building thereon, owned by the county which has been determined by the board to be of general historical interest, to a county historical society, which historical society is a nonprofit corporation formed under the laws of this state. Any such conveyance shall contain a condition to the effect that the historical nature of the property be restored, preserved, or both, for the benefit of the citizens of the county, and that title will revert to the county in the event that the historical society conveys the property in question to any person or entity which is not a nonprofit corporation involved with preserving and researching the history of the county.
