§ 21400 Safety Member Disability Benefits

Key Takeaways

  • •If a safety worker (like a cop or firefighter) gets hurt on the job and retires after January 1, 2013, they get money based on the best of three options.
  • •Option 1: Half of their last paycheck plus any extra money they saved in their retirement account.
  • •Option 2: Their regular retirement pay if they qualify for it.
  • •Option 3: A smaller amount if they’re too young (under 50) and don’t qualify for regular retirement yet.
  • •They won’t get less money than they would have before 2013.

Example

A firefighter gets hurt in a fire and can’t work anymore, so they retire at age 45.

The firefighter will get the best of these three options: half their last paycheck plus extra savings, their regular retirement pay (if they qualify), or a smaller amount because they’re under 50.
