§ 21025 Public Service Transfer Rules

Key Takeaways

  • •If a government job or task gets taken over by another group, the workers still count as doing 'public service'.
  • •This rule doesn’t automatically apply to the new group—it has to choose to follow it by signing a contract.
  • •The new group can decide later to follow this rule by changing its contract.

Example

A city’s trash pickup is taken over by a private company hired by the city.

The trash collectors still count as doing public service, but only if the private company agrees in its contract with the city.

“Public service” with respect to a local member also means service rendered to a public agency if that agency or a function of that agency is assumed by a contracting agency or a public agency that thereafter becomes a contracting agency. This section shall not apply to any contracting agency nor to the employees of any contracting agency until the agency elects to be subject to this section by contract or by amendment to its contract made in the manner prescribed for approval of contracts. (Repealed and added by Stats. 1995, Ch. 379, Sec. 2. Effective January 1, 1996.)
