§ 21009 Partial Leave Compensation Rules

Key Takeaways

  • •If a state worker takes time off for certain reasons, they might not get full pay.
  • •The worker can still get some credit for their job time, even if they weren’t fully working.
  • •The rules for how much they pay into their job benefits depend on why they took time off.
  • •The boss has to officially approve this kind of time off.

Example

A teacher takes a few months off to take care of a sick family member.

The teacher might not get their full paycheck during this time, but they can still get some credit toward their retirement or other benefits. The school has to agree to this time off, and the rules for how much the teacher pays into their benefits depend on why they’re away.

“Leave of absence” also means time during which a state member is excused from the performance of a portion of his or her duties and did not, during the absence, receive full compensation if the partial leave of absence was formally granted by the employer for one of the purposes specified in this article. The contributions and interest required of the member shall be determined by the section that defines the purpose of the leave and by the amount of service credit the member would have received had he or she not been absent.
