§ 20130 Workers' Compensation Legal Representation

Key Takeaways

  • •The board can hire the State Compensation Insurance Fund or the Attorney General to help decide if a worker's death or injury happened because of their job.
  • •The retirement fund pays for this help, but if the worker is from a General Fund state agency, the Attorney General’s help is free.
  • •This rule started on January 1, 1996.

Example

A firefighter gets hurt while putting out a fire and can’t work anymore. The board isn’t sure if the injury is because of the job or something else.

The board can ask the Attorney General to help figure out if the injury is work-related. Since firefighters work for the state, the Attorney General’s help won’t cost anything.
