§ 17567 Claim Proration Rules

Key Takeaways

  • •If there's not enough money to pay everyone who filed a claim, the money gets split fairly based on how much each person asked for.
  • •If more money is added later, the payments can be adjusted to give people the correct amount.
  • •If the total money available is $1,000 or less, the person in charge can choose the cheapest way to hand it out.

Example

Imagine 10 people filed claims for $100 each, but there's only $500 total to give out.

Instead of paying everyone the full $100, each person gets half ($50) because there's not enough money. If later, $500 more is added, they might get the other half.

§ 17567 Claim Proration Rules

In the event that the amount appropriated for reimbursement purposes pursuant to Section 17561 is not sufficient to pay all of the claims approved by the Controller, the Controller shall prorate claims in proportion to the dollar amount of approved claims timely filed and on hand at the time of proration. The Controller shall adjust prorated claims if supplementary funds are appropriated for this purpose. Notwithstanding any other law, if one thousand dollars ($1,000) or less is appropriated for a program, the Controller shall determine the most cost-effective allocation method. (Amended by Stats. 2013, Ch. 77, Sec. 1. (AB 392) Effective January 1, 2014.)
