§ 16346 Fund Transfer On Abolition

Key Takeaways

  • •If a special money fund in the state is closed, all its money and debts move to a new fund chosen by the law.
  • •If the law doesn’t pick a new fund, the money goes to the General Fund (the state’s main money pot).
  • •Money already set aside for specific projects in the old fund can still be used for those projects in the new fund.
  • •Rules that automatically set aside certain money for a fund don’t count as ‘specific projects’ here.

Example

The state closes a special fund that was used to fix parks. The law says the money should go to a new ‘Outdoor Spaces Fund.’

All the leftover money from the old park fund moves to the new ‘Outdoor Spaces Fund.’ If some of that money was already promised to fix a playground, it can still be used for that playground.

§ 16346 Fund Transfer On Abolition

Whenever by statutory enactment or operation of the law, a special fund in the State Treasury is abolished, all of its assets, liabilities, and surplus shall, on order of the State Controller and as of the effective date of its abolition, be transferred to and become a part of the successor fund specified in the act providing for such abolition. Unless otherwise provided, all existing appropriations to the extent encumbered and also those which had been made for particular projects from the abolished fund shall continue to be available for the same purposes and periods from the successor fund. Where no successor fund is specified in the act providing for abolition, the General Fund shall be deemed to be the successor fund for purposes of this section. Provisions of law continuously appropriating certain classes of revenue or other receipts upon their deposit in a particular fund in the State Treasury are not appropriations for particular projects for purposes of this section. (Amended by Stats. 1961, Ch. 892.)
