§ 15283 Public Safety Communications Fund

(a) For purposes of this section, “fund” means the Public Safety Communications Revolving Fund. (b) The Public Safety Communications Revolving Fund is hereby created within the State Treasury. The fund shall be administered by the director and shall be used, upon appropriation by the Legislature, to pay all costs to the office resulting from this chapter or from rendering services to the state or other public agencies, which costs include, but are not limited to, costs of employing and compensating necessary personnel, expenses such as operating or other expenses of the division, and costs associated with approved public safety communications projects, and to establish reserves. The director, at his or her discretion, may establish segregated, dedicated accounts within the fund. (c) The fund shall consist of all of the following: (1) Revenues from the provision or sale of public safety communications services provided for in this chapter or of other services rendered by the division. (2) Moneys appropriated and made available by the Legislature for the purposes of this chapter. (3) Any other moneys properly credited or made available to the division from any other source, including, but not limited to, the return from investments of moneys by the Treasurer. (d) Pursuant to Section 11255, the Controller shall, at the request of the division and consistent with the annual budget of each state department, transfer to the fund any payment authorized to be collected by the division from public agencies for the division’s services. The division shall notify each affected state agency upon requesting the Controller to make any transfer pursuant to this subdivision. (e) If the balance remaining in the fund at the end of any fiscal year exceeds 25 percent of the portion of the division’s budget for that fiscal year that is used for supporting public safety communications and other client services, the excess amount shall be used to reduce the billing rates for services rendered by the office during the following fiscal year. (f) This section shall become operative on July 1, 2016. (Added by Stats. 2016, Ch. 32, Sec. 64. (SB 837) Effective June 27, 2016. Section operative July 1, 2016, by its own provisions.)
