§ 12431 Claim Cost Recovery Certification

• •Before getting paid from a special fund, you must promise in writing that you tried to get your money back from the person who caused the problem.
• •This rule is for people or groups asking for money from a fund set up by a law in 1977.
• •You have to show you tried to use other laws (Penal Code Sections 1203.1 and 1203.1b) to get your money back first.

Imagine someone breaks your window and runs away. You ask the government for money to fix it from a special fund.

Before the government gives you the money, you must write a promise saying you tried to make the person who broke the window pay for it first.
