§ 11516 Amending Accusations After Submission

Key Takeaways

  • •The agency can change the complaint or layoff notice after the case is submitted for a decision.
  • •Both sides will be told about the change and can say if it hurts their case.
  • •If the change hurts someone's case, the agency will reopen the case so they can add more proof.

Example

A teacher is told they are being laid off because the school has no money. After the teacher responds, the school changes the reason to say the teacher did a bad job.

The teacher can say this new reason is not fair because they didn’t get to show proof they did a good job. The school must then let the teacher show that proof.

The agency may order amendment of the accusation or District Statement of Reduction in Force after submission of the case for decision. Each party shall be given notice of the intended amendment and opportunity to show that he or she will be prejudiced thereby unless the case is reopened to permit the introduction of additional evidence on his or her behalf. If such prejudice is shown, the agency shall reopen the case to permit the introduction of additional evidence. (Amended by Stats. 2013, Ch. 90, Sec. 9. (SB 546) Effective January 1, 2014.)
