§ 1130 Salary Withholding In Contests

Key Takeaways

  • •If someone is fighting in court about who should have a government job,
  • •the person currently in that job won't get paid until the court decides who really owns the job.
  • •This rule makes sure money isn't paid to the wrong person while the fight is happening.

Example

Imagine two people, Alex and Jamie, both say they won the election to be mayor. They go to court to figure out who really won.

While the court is deciding, the town won't pay Alex (the current mayor) any money. Once the court says who the real mayor is, that person will start getting paid again.
