§ 6523 Association Advertising Rules

Key Takeaways

  • •Associations can advertise, but they must tell the truth about their services, contracts, investments, and money situation.
  • •The commissioner can ask to see the ad before it's shown to the public, and the association must wait for approval or 5 days before using it.
  • •If the commissioner says an ad is lying or misleading, the association must stop using it right away.

Example

A health insurance company wants to run a TV ad saying they cover all medical costs.

The company must make sure the ad is true and not misleading. They might have to show the ad to the commissioner first. If the commissioner finds out the ad is lying (like if they don’t actually cover all costs), they’ll tell the company to stop running the ad.

Advertising filed under this subdivision may be used upon the commissioner’s express approval or failure to disapprove it within five days of its filing. (c) Associations shall not issue, circulate, or publish any advertising after notice in writing from the commissioner that in the commissioner’s opinion the advertising is inaccurate or misrepresents the association’s services, contracts, investments, or financial condition.
