§ 50304 Commissioner Rulemaking Authority

Key Takeaways

  • •The person in charge (commissioner) can make, change, or cancel rules to make sure this law works right.
  • •They can create different rules for different types of loans or people, if needed.
  • •The commissioner can decide to ignore a rule if they think it’s not helpful or fair for people borrowing or investing money.

Example

A new type of loan becomes popular, like loans for electric cars.

The commissioner can make new rules just for these loans to make sure people are treated fairly. If one of the rules is too strict and doesn’t really help anyone, the commissioner can decide to skip it.

§ 50304 Commissioner Rulemaking Authority

The commissioner may, from time to time, make, amend, and rescind the rules, forms, and orders that are necessary to carry out the provisions of this law, including rules and forms governing applications and reports, and defining any terms, whether or not used in this law, provided that the definitions are consistent with the provisions of this law. For the purposes of rules and forms, the commissioner may classify loans, persons, and matters within the jurisdiction of the commissioner, and may prescribe different requirements for different classes. The commissioner may, in his or her discretion, waive a requirement of a rule or form if, in the opinion of the commissioner, the requirement is not in the public interest or necessary for the protection of borrowers or investors. (Added by Stats. 1994, Ch. 994, Sec. 7. Effective January 1, 1995. Section operative January 1, 1996, pursuant to Section 50601 (later repealed).)
