§ 3405 Enforcement Procedures Notice Hearing

Key Takeaways

  • •The department usually has to give notice and a chance for a hearing before taking action.
  • •In emergencies, the department can act first and give a hearing later.
  • •If someone doesn’t ask for a hearing on time, the department can act without one.

Example

A company is doing something risky with people’s money online, and the department thinks it needs to stop right away to protect everyone.

The department can shut it down immediately without waiting for a hearing first, but the company can still ask for a quick hearing afterward to explain their side.
