§ 177 Foreign Bank Definition

This law clarifies that "state of the United States" includes all U.S. states and the District of Columbia, and it defines "foreign (other nation)" for banks and other corporations.

Key Takeaways

  • •The term "state of the United States" here means any U.S. state or the District of Columbia.
  • •For banks, "foreign (other nation)" means a bank not organized under a U.S. state law and not a national bank whose main office is in a U.S. state.
  • •For other corporations, "foreign (other nation)" means a corporation organized under the laws of a foreign country.

Example

A U.S. bank opens a branch in Mexico City.

Because the branch is located outside any U.S. state, the law treats it as a "foreign (other nation)" office of the bank.
