§ 17335 Appeals By Commissioner Or Fidelity

This law lets the commissioner or Fidelity Corporation ask a higher court to review a court decision, but the appeal doesn’t automatically pause the decision unless the court says so.

Key Takeaways

  • •Both the commissioner and Fidelity can appeal a court judgment.
  • •An appeal does not automatically stop the judgment from being enforced.
  • •The court can order a pause (stay) only if there’s good reason.
  • •The commissioner does not have to post a bond; Fidelity must post a bond as required by other code sections.

Example

A court orders Fidelity Corporation to pay a fine. Fidelity wants to challenge that order.

Fidelity can file an appeal, but it must give a bond as required by other rules before the court might pause (stay) the fine. If the commissioner appealed the same order, no bond would be needed.

§ 17335 Appeals By Commissioner Or Fidelity

An appeal may be taken from the judgment of the court by the commissioner or by Fidelity Corporation in the manner provided by law for appeals from the judgment of a superior court to the court of appeal. An appeal from the judgment of the court does not operate as a stay of the judgment unless the court, on good cause, so orders. No bond need be given if the appeal is taken by the commissioner, but if the appeal is taken by Fidelity Corporation a bond shall be given as required by Sections 917.2 and 917.5 of the Code of Civil Procedure as a condition to any stay. (Amended by Stats. 1998, Ch. 931, Sec. 148. Effective September 28, 1998.)
