§ 17201 Escrow Agent License Application

This law says you have to apply in writing and swear an oath to get an escrow‑agent license, and it lets the commissioner decide if electronic forms and signatures can be used, but doesn’t force them to accept them.

Key Takeaways

  • •You must submit a written license application in the form the commissioner sets and swear an oath.
  • •The commissioner can make rules that let you use electronic records or signatures, but the law doesn’t force the commissioner to accept them.
  • •An “electronic record” is any license‑related document created or sent electronically, and an “electronic signature” is a digital sound, symbol, or process that shows you meant to sign that document.
  • •The state encourages the department to use more electronic filing when it has the money and tools to do so.

Example

Jane wants to become a licensed escrow agent and thinks about sending her application through an online portal.

Jane must fill out a paper application and sign an oath as the law requires. The commissioner can choose to let her send it electronically, but the commissioner doesn’t have to allow it, so Jane might still need to mail a hard copy.
