§ 14303 Cease And Desist Orders

This law lets a government official quickly order someone to stop breaking a rule, either because they already broke it or are about to break it soon, and it gives the person a way to challenge that order.

Key Takeaways

  • •The official can stop a violation right away without any prior notice or hearing.
  • •The person ordered to stop can request a hearing, and if the hearing isn’t held in time, the order ends.
  • •Even if the person doesn’t ask for a hearing, they can still go to court to review the order.

Example

A city official sees a homeowner dumping trash in a public park and thinks the homeowner will keep doing it.

The official can issue an immediate order telling the homeowner to stop dumping trash without giving any warning. The homeowner can then ask for a hearing. If the hearing isn’t scheduled within 15 business days, the order is automatically cancelled.
