§ 100016 Privacy Protection For Licensing Data

This law says that any personal or business information you give to the Nationwide Multistate Licensing System (NMLS) stays private and protected, even when it’s shared with state or federal regulators, except for publicly available employment and disciplinary records.

Key Takeaways

  • •Info given to NMLS stays private even after it’s shared with regulators.
  • •Regulators can see the info without losing its confidentiality protections.
  • •You can’t be forced to reveal that info in a private civil case unless you waive the privilege.
  • •Employment history and publicly decided disciplinary actions are the only parts that can be made public.

Example

A mortgage broker submits his financial statements to NMLS. Later, a private lawsuit tries to force the broker to hand over those statements.

Because of this law, the broker’s statements stay confidential and can’t be used in the private lawsuit unless the broker agrees to give them up. Regulators can still see the information, but it stays protected from public disclosure.
