§ 100009 Debt Collection License Investigation

When a partnership or a company applies for a license, the commissioner must look into the people who run it, own a big chunk of it, or are in charge of its debt‑collection activities.

Key Takeaways

  • •The commissioner must investigate specific people when a license application is filed.
  • •For partnerships, the investigation includes the partnership, its managing partners, anyone with 10% or more ownership, and the debt‑collection manager.
  • •For corporations, trusts, LLCs, and similar groups, the investigation adds officers, board members, trustees, managing members, and anyone with 10% or more equity.
  • •The person who runs debt‑collection activities at the listed location is always investigated, even if they weren’t checked before.

Example

A small partnership that wants a debt‑collection license files the application and pays the fee.

The commissioner will check the partnership itself, its managing partners, anyone who owns 10% or more of the partnership, and the person who decides how the partnership collects debts. If any of those people have problems, the license could be denied.
