§ 8460 Live Bait Fish License

Key Takeaways

  • •You need a special license to catch, move, or sell live freshwater fish for bait if you're doing it to make money.
  • •The license lasts for one year (or less if you get it late in the year) and can be taken away if you break the rules.
  • •You don’t need this license if you’re raising or selling bait fish under a different set of rules (Division 12).
  • •The usual fishing business rules (like reports or boat statements) don’t apply to bait fish.

Example

If you start a small business selling live minnows to fishermen, you need to get a bait fish license first.

Without the license, you could get in trouble even if you’re just trying to make a little money selling bait.

§ 8460 Live Bait Fish License

Any person engaged for profit in the taking, transporting, or selling of live fresh-water fish for bait shall first obtain from the department a live fresh-water bait fish license to possess the fish for those purposes. The commission may prescribe regulations governing these licenses. A license shall be issued for a calendar year, or, if issued after the beginning of such term, for the remainder thereof, and may be revoked for a violation of the terms thereof. Such a license is not required for the raising, possession, or sale of live fresh-water fish for bait under authority of Division 12 (commencing with Section 15000). The provisions of this code on commercial fishing, packing, or processing licenses, on reports by persons engaged in the commercial fish industry, and on statements required by owners or operators of fishing boats, do not apply to the taking, transporting, or selling of live fresh-water fish for bait. (Amended by Stats. 1983, Ch. 1300, Sec. 11.)
