§ 6704 Kelp Lease Renewal Rights

Key Takeaways

  • •If you follow the rules of your kelp bed lease, you get first dibs to renew it before anyone else can bid.
  • •If you don’t follow the rules or can’t agree on new terms, the kelp bed goes up for auction.
  • •You have to ask to renew your lease during a specific time—if you miss it, the kelp bed gets auctioned off.
  • •A renewed lease can’t last longer than 20 years.

Example

A fisherman has been leasing a kelp bed for years, following all the rules, and wants to keep using it.

Since he followed the rules, he gets the first chance to renew his lease. If he and the commission agree on the new terms, he can keep the kelp bed for up to 20 more years. If they can’t agree or he broke the rules, the kelp bed will be put up for auction so others can bid on it.

(b) If terms for a renewal of the lease are not agreed upon, or the commission determines that the lessee has not complied with the terms of the lease, the commission shall advertise for bids on the individual kelp beds comprising the lease. (c) If a request for renewal is not made during the specified period by the lessee, the commission shall advertise for bids on the individual kelp beds comprising the lease. (d) The duration of the term of any renewal of a lease shall not exceed 20 years. (Amended by Stats. 2023, Ch. 132, Sec. 123. (AB 1760) Effective January 1, 2024.)
