§ 5989 Screen Maintenance Responsibility

• •If a screen stops working right after it was accepted, the owner doesn’t have to pay for a new one.
• •The department can put in a new screen, but they have to pay for it themselves.
• •The new screen must be the same type, size, and mesh as the old one, and both the owner and the department must agree on where it goes.

A farmer has a screen installed to filter water for his crops. After a few months, the screen breaks even though nothing changed in how it was used.

The farmer doesn’t have to pay for a new screen. If the department wants to put in a new one, they have to cover the cost and make sure it’s the same as the old screen.
