§ 1925 Department Desert Plant Enforcement

This law says the state department makes sure the Desert Native Plants rules are followed, but the county ag commissioner or sheriff give out the permits and tags. The department can also take, grow, import, and give out native plants for science, and those actions aren’t covered by the Act.

Key Takeaways

  • •The department enforces the California Desert Native Plants Act.
  • •Permits, tags, seals, and wood receipts are issued by the county agricultural commissioner or the sheriff, not the department.
  • •The department can take, grow, import, and give out native plants for scientific or propagation purposes, and the Act doesn’t limit those activities.

Example

A farmer wants to harvest a desert plant. The sheriff gives the farmer a permit, and the state department checks that the harvest follows the Desert Native Plants rules. At the same time, the department can collect some desert plants for a university research garden without needing a permit.

The sheriff issues the permit, the department enforces the rules, and the department can also take plants for research without breaking the law.

§ 1925 Department Desert Plant Enforcement

The department shall enforce the provisions of the California Desert Native Plants Act Division 23 (commencing with Section 80001) of the Food and Agricultural Code except that permits, tags, seals, and wood receipts shall be issued pursuant to Chapter 4 (commencing with Section 80101) of Division 23 of the Food and Agricultural Code, by the county agricultural commissioner or the sheriff. Nothing in the California Desert Native Plants Act, or any other law, prohibits the department from taking, for scientific or propagation purposes, any species of native plants. The department may import, propagate, and distribute native plants, and the California Desert Native Plants Act does not apply to those activities. (Amended by Stats. 1985, Ch. 106, Sec. 34.)
