§ 1907 Endangered Plant Regulations

This law lets the commission set rules for taking, moving, or selling endangered native plants, requiring permits and written records, but it does not require permits for plants that are grown in nurseries.

Key Takeaways

  • •The commission can make rules about handling endangered native plants.
  • •Anyone who takes, moves, or sells wild endangered plants must get a permit and keep records.
  • •Plants grown in nurseries do not need a permit unless they involve wild endangered species.

Example

A person finds a rare wild cactus in the desert and wants to sell it to a collector.

Because the cactus is a wild, endangered plant, the person must get a permit and keep written records as the law requires. If the same cactus were bought from a nursery, no permit would be needed.
