§ 1613 Notification Violation Suspension

This law lets the department pause a pending agreement if it finds a violation before finalizing it, and certain time limits don't apply while the violation is being addressed.

Key Takeaways

  • •The department can halt processing if it finds a violation before a final agreement.
  • •Normal processing timelines are suspended during this pause.
  • •The pause ends if the violation is fixed, the statute of limitations runs out, or prosecution stops.

Example

A company gets a notice about a project, and the department later says the project breaks environmental rules.

The department can stop working on the project paperwork until the problem is fixed or legal action ends, and the usual deadlines for processing don't have to be followed.

This section ceases to apply if any of the following occurs: (a) The department determines that the violation has been remedied. (b) Legal action to prosecute the violation is not filed within the applicable statute of limitations. (c) Legal action to prosecute the violation has been terminated. (Amended by Stats. 2016, Ch. 340, Sec. 4. (SB 839) Effective September 13, 2016.)
