§ 13012 Subaccount Funding Limits

This law caps how much money each special fund can hold, and any extra money in the fish and wildlife pollution account after June 30 must be spent on projects that protect California’s plants, animals, and fish.

Key Takeaways

  • •Each sub‑account can only hold a set amount: $5 M for Oil Pollution Administration, $10 M for Oil Pollution Response, $5 M for Hazardous Materials Administration, and $10 M for Hazardous Material Response.
  • •The dollar limits are based on 1995 dollars and are adjusted as required by another tax code section.
  • •Any money left over in the Fish and Wildlife Pollution Account after June 30 must be used for projects that preserve California’s plants, wildlife, and fisheries.

Example

At the end of the fiscal year, the department’s fish and wildlife pollution account has $3 million more than the total limits for the four sub‑accounts.

Because the extra $3 million is over the allowed amount, the department has to use that money in the next years for things like planting native trees, restoring wetlands, or protecting fish habitats.
