§ 12164 Trespassing Wildlife Confiscation

If you're found guilty of trespassing and you took a bird or animal while you were on the property, the court will take that bird or animal away and give it to a charity, or destroy it if it can't be eaten.

Key Takeaways

  • •A trespassing conviction can lead to the animal taken on the property being taken away.
  • •The court decides whether the animal goes to a charity or is destroyed.
  • •This rule works in addition to any other fines or penalties the court may impose.

Example

A person sneaks onto a farmer's land and shoots a rabbit without permission. The person is later convicted of trespassing.

Because the rabbit was taken while trespassing, the court will seize the rabbit and either give it to a local food bank or, if the rabbit is not safe to eat, have it destroyed.
