§ 2063 Employee Benefit Plan Response

This law says that if someone wants to add an employee benefit plan to a lawsuit, the plan has 30 days to respond. If they don't respond with their own paperwork, it's like they're saying they disagree with everything in the lawsuit.

Key Takeaways

  • •If you're adding an employee benefit plan to a lawsuit, they have 30 days to respond.
  • •If the plan doesn't file their own paperwork, it's like they're disagreeing with everything in the lawsuit.
  • •This rule helps make sure lawsuits move forward even if the plan doesn't fully respond.

Example

Imagine you're suing your company for not paying your health benefits, and you want to include the health insurance plan in the lawsuit.

The health insurance plan has 30 days to say they're part of the case. If they don't say anything else, it's like they're automatically saying they disagree with your claims.
