§ 17526 Child Support Arrearage Review

This law lets parents ask for a review if they think the amount of unpaid child support (arrearages) is wrong. The local child support agency checks the evidence and can pause collection if it seems likely the debt isn't owed.

Key Takeaways

  • •Either parent can ask for a review if they think the unpaid child support amount is wrong
  • •The agency must check both parents' evidence about payments
  • •They can pause collection if it looks like the debt might not be real
  • •You can ask a judge to decide if you're still unhappy after the review
  • •The review must happen quickly, like a complaint

Example

A dad gets a bill saying he owes $10,000 in back child support, but he thinks he already paid most of it.

He can ask the child support agency to review the bill. They'll check his payment records and the mom's records to see if the $10,000 is correct. If it looks like he might not owe it, they can pause collection while they figure it out.

How to Calculate

No specific formula in this section. The review is based on comparing records of payments vs. amounts ordered.

  1. Gather all payment records (receipts, bank statements, etc.)
  2. Compare them to the court-ordered child support amounts
  3. Subtract what was paid from what was ordered to find the real amount owed

Court ordered $500/month for 12 months, but dad claims he paid some.

Result: $6,000 - $3,000 = $3,000 still owed (if records are correct)

§ 17526 Child Support Arrearage Review

(a) Upon request of an obligor or obligee, the local child support agency shall review the amount of arrearages alleged in a statement of arrearages that may be submitted to the local child support agency by an applicant for child support enforcement services. The local child support agency shall complete the review in the same manner and pursuant to the same timeframes as a complaint submitted pursuant to Section 17800. In the review, the local child support agency shall consider all evidence and defenses submitted by either parent on the issues of the amount of support paid or owed. (b) The local child support agency may, in its discretion, suspend enforcement or distribution of arrearages if it believes there is a substantial probability that the result of the administrative review will result in a finding that there are no arrearages. (c) Any party to an action involving child support enforcement services of the local child support agency may request a judicial determination of arrearages. The party may request an administrative review of the alleged arrearages prior to requesting a judicial determination of arrearages. The local child support agency shall complete the review in the same manner and pursuant to the same timeframes specified in subdivision (a). Any motion to determine arrearages filed with the court shall include a monthly breakdown showing amounts ordered and amounts paid, in addition to any other relevant information. (d) A county that submits a claim for reimbursement as a state-mandated local program of costs incurred with respect to the administrative review of alleged child support arrearages under this section shall be ineligible for state subventions or, to the extent permitted by federal law, state-administered federal subventions, for child support in the amount of any local costs under this section. (Amended by Stats. 2002, Ch. 927, Sec. 6.5. Effective January 1, 2003.)
