§ 79952 Commission Liability Limitations

Key Takeaways

  • •The state won't pay for mistakes made by the commission or its contracts.
  • •If someone has a claim against the commission, they can only get money from the commission's own funds, not from the state.
  • •People working for the commission (like board members or employees) can't be personally sued for mistakes or bad decisions, unless they did something dishonest or illegal.
  • •Each board member is only responsible for their own actions, not for what other members do.

Example

A farmer sues the commission because they think a bad decision hurt their crops.

The farmer can't sue the state or the commission workers personally. They can only try to get money from the commission's own funds, and only if someone in the commission did something dishonest or illegal.
