§ 77665 Commission Funds Distribution Rules

Key Takeaways

  • •If the commission closes, any leftover money goes back to the people who paid into it.
  • •If the leftover money is too small to split fairly, it goes to a school or government program that helps with the same stuff the commission did.
  • •If there’s no such program, the money goes to the state as unclaimed funds.

Example

A group of farmers paid money to a commission that helped sell their crops. The commission closes, and there’s $1,000 left.

If splitting $1,000 between all the farmers is too hard (like if it’s only $1 per farmer), the money might go to a school program that helps farmers instead.

§ 77665 Commission Funds Distribution Rules

After the effective date of suspension, the operation of the commission shall be concluded and the funds remaining held by the commission and not required to defray the expenses of concluding and terminating operations of the commission, shall be returned upon a pro rata basis to all producers from whom assessments were collected in the immediately preceding marketing year. However, if the commission finds that the amounts so returnable are so small as to make impractical the computation and remitting of the prorate refund to these producers, the remaining funds shall be withdrawn from the approved depository and paid to an appropriate program conducted by the University of California or the California State University, another state agency, or a federal agency which deals with the purposes of this chapter. If no such program exists, the funds shall be paid to the State Treasury as unclaimed trust funds. (Added by Stats. 1990, Ch. 550, Sec. 1. Effective August 27, 1990.)
