§ 74956 Grape Assessment Payment Rules

Key Takeaways

  • •If you're a winemaker (vintner) buying grapes, you must take out a small fee (assessment) from the money you pay the grape grower (producer).
  • •You have 30 days to pay that fee to the commission after you take it from the grape grower's payment.
  • •You can keep a little bit of the fee to cover your costs, but only if the commission says it's okay.
  • •Even if you forget to take the fee from the grape grower, you still have to pay it, and the grape grower still owes it.

Example

A winemaker buys grapes from a farmer for $10,000. There's a $200 fee that needs to be paid to the commission.

The winemaker must take the $200 from the $10,000 they pay the farmer and send it to the commission within 30 days. If the winemaker spends $20 to handle the fee, they can keep that $20 but must still send $180 to the commission. If the winemaker forgets to take the $200 from the farmer, they still have to pay the $200 themselves.

§ 74956 Grape Assessment Payment Rules

Any assessment levied by the commission, pursuant to this chapter, is a personal debt of every person so assessed and is due and payable to the commission within 30 days after the date the vintner deducts the assessment from the amounts paid by the vintner to the producer. The vintner first acquiring the grapes being assessed shall deduct the assessments from amounts paid by the vintner to the producer and shall be a trustee of the funds until they are paid to the commission. The vintner responsible for deducting the assessment may deduct and retain an amount not in excess of that reasonably necessary to cover the actual cost of services provided by the vintner, as determined by the commission. Failure of a vintner to collect the assessment from a producer shall not exempt the vintner from liability nor relieve the producer of the obligation to pay the assessment. (Amended by Stats. 1992, Ch. 689, Sec. 11.5. Effective January 1, 1993.)
