§ 66663 Commission Funds Refund Process

Key Takeaways

  • •If the commission stops working, any leftover money they have must be given back to the people who paid it.
  • •The money is given back based on how much each person paid in the last year.
  • •If the leftover money is too small to split fairly, it goes to the state instead of being given back.

Example

A group of farmers paid money to a commission that helped sell their crops. The commission closed down and had $1,000 left after paying all its bills.

The commission will give the $1,000 back to the farmers based on how much each paid last year. If splitting the money fairly is too hard because the amounts are too small, the money goes to the state instead.

§ 66663 Commission Funds Refund Process

After the effective date of suspension of the operation of the provisions of this chapter and of the commission, as provided in Section 66662, the operations of the commission shall be wound up and any moneys remaining held by the commission, collected by assessment and not required to defray the expenses of winding up and terminating operations of the commission, shall be returned upon a pro rata basis to all handlers from whom assessments were collected in the immediately preceding current fiscal year. However, if the commission finds that the amounts so returnable are so de minimis as to make impractical the computation and remitting of such pro rata refund to such handlers, any moneys remaining after payment of all expenses of winding up and terminating operations shall be withdrawn from the approved depository and paid into the State Treasury as unclaimed trust moneys. (Amended by Stats. 2004, Ch. 183, Sec. 127. Effective January 1, 2005.)
