§ 55439 Severability Of Provisions

Key Takeaways

  • •If a small part of this law is found to be wrong or invalid, the rest of the law still works.
  • •Only the bad part gets removed, not the whole law.
  • •This rule helps keep most of the law in place even if one piece has a problem.

Example

Imagine a rulebook for a school that says kids must wear uniforms, but one rule says 'no red shoes' is unfair.

If a judge says the 'no red shoes' rule is bad, the rest of the uniform rules (like wearing a shirt or pants) still apply. Only the 'no red shoes' part is removed.
