§ 52451 Seed Sale Exemptions

Key Takeaways

  • •This law doesn't apply to seeds or grain that aren't meant for planting.
  • •Seeds being cleaned or stored in a special place for cleaning are not covered by this law.
  • •If you move seeds to your own land without selling them, this law doesn't apply.
  • •Seeds sold in bulk (like from a big bin) are okay if the bin is labeled right and the buyer watches it being packed.
  • •Seeds moved between warehouses or stored there are fine if they have the right labels and info is available if an officer asks.
  • •Seeds shared for free (not sold) are not covered by this law.

Example

A farmer grows wheat and moves some of it to his own field to plant next year.

This law doesn’t apply because the farmer isn’t selling the seeds—he’s just moving them to his own land.
