§ 5024 Plant Quarantine Inspection Rules

Key Takeaways

  • •If there's a quarantine for plants or bugs, officials must check plants or items that might carry pests before they can move past the quarantine line.
  • •Only plants or items with a special inspection certificate can be moved during the quarantine.
  • •If officials decide a plant or item is safe and won't harm the state, they can skip the inspection and certificate rules.

Example

A farmer wants to move a truckload of fruit trees from a quarantined area to sell at a market outside the quarantine zone.

The farmer must get the trees checked by an official first. If the trees are pest-free, the official will give a certificate allowing the farmer to move them. If the official sees the trees are safe and won't spread pests, they might let the farmer move them without the usual check.

The person who conducts the inspection shall not permit any of those plants or things to pass over the quarantine line during the quarantine, except pursuant to a certificate of inspection and release that is signed by that person. (b) Whenever the commissioner finds that a plant or thing does not, and will not, present a threat to the state, the commissioner may recommend to the secretary the waiver of, and the secretary may waive, the inspection and certification requirements specified in subdivision (a).
