§ 5004 Noxious Weed Definition Criteria

Key Takeaways

  • •A 'noxious weed' is a plant that can hurt farms, forests, or important local plants and is hard to get rid of.
  • •The government decides which plants are called 'noxious weeds'.
  • •If calling a plant a 'noxious weed' would hurt farming, the government won't do it.

Example

A new type of fast-growing grass starts spreading in a farmer's field.

If this grass is hard to remove and hurts the crops, the government might call it a 'noxious weed'. But if getting rid of this grass would also hurt the farmer's other plants, the government won't call it a 'noxious weed'.

§ 5004 Noxious Weed Definition Criteria

“Noxious weed” means any species of plant that is, or is liable to be, troublesome, aggressive, intrusive, detrimental, or destructive to agriculture, silviculture, or important native species, and difficult to control or eradicate, which the director, by regulation, designates to be a noxious weed. In determining whether or not a species shall be designated a noxious weed for the purposes of protecting silviculture or important native plant species, the director shall not make that designation if the designation will be detrimental to agriculture. (Amended by Stats. 1992, Ch. 556, Sec. 1. Effective January 1, 1993.)
