§ 42912 Carrier Transport Of Produce

Key Takeaways

  • •Trucking companies that carry fruits, nuts, or veggies can't get in trouble for breaking the rules unless they do it on purpose.
  • •If a cop or inspector tells them in writing to stop carrying bad or illegal produce, they must stop quickly.
  • •If they ignore the warning and keep carrying the bad stuff, they can get in trouble.

Example

A trucking company is carrying a load of strawberries that were picked too early and aren't ripe yet. An inspector finds out and tells the company in writing to stop transporting those strawberries because it's against the rules.

If the company keeps driving those strawberries to stores after getting the warning, they can get in trouble. But if they stop right away, they won't get punished.
