§ 16421 Violation Penalties And Fines

This law says that if you break the rules listed in this part, you are charged with a misdemeanor and can be fined between $100 and $1,000 and/or sent to jail for at least 10 days, up to a year (or up to six months for certain listed violations). Each day you break the rule counts as a separate crime.

Key Takeaways

  • •Every day you break the rule is counted as a new crime.
  • •Fines can be anywhere from $100 to $1,000 for each day.
  • •Jail time is at least 10 days; it can be up to a year, but only up to six months for the specific violations listed in subsection (b).

Example

John parks his car in a no‑parking zone for three days in a row.

Because each day is a separate violation, John could be fined and jailed for each of the three days under this law.

How to Calculate

Penalty = Fine (minimum $100, maximum $1,000) + Imprisonment (minimum 10 days, maximum 1 year for (a) or 6 months for (b)) per day of violation

  1. Decide if the violation falls under subsection (a) or the listed violations in subsection (b).
  2. Choose the fine amount within the $100‑$1,000 range (court may set any amount in that range).
  3. Choose the jail time within the allowed range (10 days up to 1 year for (a) or up to 6 months for (b)).
  4. Multiply the fine and jail time by the number of days the person violated the rule, because each day is a separate offense.

Maria breaks a violation listed in subsection (b) for 2 days.

Result: Total fine = $150 × 2 = $300; Total jail time = 10 days × 2 = 20 days.
