§ 15091 Department Injunction Authority

This law lets the department go to court to stop anyone from breaking the rules in this chapter, and the court can order them to stop right away or forever.

Key Takeaways

  • •The department can sue in superior court to stop rule violations.
  • •The court can issue temporary or permanent orders (injunctions) to stop the bad behavior.
  • •The department doesn't have to prove the damage is irreversible to get the order.
  • •The case must follow the civil‑procedure rules in Chapter 3 of Title 7, Part 2.
  • •The court can also order other actions needed to make the law work.

Example

A factory starts dumping polluted water into a river even though the rules say it can't.

The department can file a lawsuit, and the judge can order the factory to stop dumping right away and maybe forever, without having to prove the river is already badly damaged.
